Our parent company is a top 15 SBA 7(a) preferred lender with SBA express and small loan capabilities.Position Description:We are seeking an SBA attorney with applicable experience in all stages of loan making under the United States Small Business Administration. The ideal candidate will have hands-on-experience with commercial lending and loan closing. The SBA Attorney position will be working under the company’s in-house General Counsel and will assist with a wide range of assignments and tasks that commonly arise in a fast-paced legal SBA environment. Essential Duties and Responsibilities:
- Review the loan commitment letter, underwriter loan write-up, and terms and conditions for consistency and compliance with Lender and SBA policy
- Coordinate with closing team for compliant and expeditious closing
- Review and assist with discrepancies on applicable reports (UCC search, judgment, bankruptcy and lien search, title report, flood search, etc.) and, where applicable, follow up with outside vendors to ensure receipt in a timely manner
- Act as liaison with borrower counsel and title company for loan requirements
- Review documents received from borrower for sufficiency and SBA compliance
- Provide guidance to closing team, underwriting team, and paralegal staff
- Provide management with status of loan closing efforts and receipt/non-receipt of pre-closing requirements on an ongoing basis
- Work closely with processing, underwriting, closing and post-closing departments to insure closing in accordance with loan approval and compliance with SBA policy
- Prepare loan documents for legal enforceability in respective jurisdictions and compliant with SBA policy
- Oversee and coordinate loan closing and collection of executed loan documents
- Direct escrow agent’s actions, oversee and obtain evidence for disbursement of loan funds in accordance with loan approval and SBA regulations
- Keep abreast of day-to-day policy and procedure and SBA SOP changes
- Adhere to turn time requirements
- Other duties as assigned
Knowledge Skills and Abilities:
- Admission to state bar in good standing
- Minimum of 2 - 5 years SBA loan closing experience
- Knowledge and direct experience with SBA compliance procedures and processes
- Experience with SBA reviews and audits
- Strong understanding of United States Small Business Administration’s regulations and Standard Operating Procedures with related experience in all stages of loan making (origination, servicing, liquidation) is required
- Experience with LaserPro is a plus
- Proficient with MS Office suite
- Good calendar management skills required
- Ability to work in a challenging environment to achieve production goals
- Strong organizational, verbal, and written communication skills required
- Ability to establish and maintain effective work relationships both internally and externally
