Summary
This position is part of the leadership team and provides in-house counsel and legal services to the organization; implements and monitors legal strategy to ensure compliance and best practices with various regulatory issues and is responsible for instilling a strict culture of compliance throughout the organization. Helps coordinate the development and implementation of legal processes and policies for Father Joe’s Villages, provides counsel to all departments within the organization as well as the Board of Directors on a wide range of issues, including contracts and grants, trademark and copyright, labor and employment, landlord and tenant, and general non-profit corporate and governance matters.
The General Counsel oversees and manages all aspect of insurance and litigation matters.
Essential Functions
- Recruits, recommends candidates for hire and/or hires and manages the Executive Legal Assistant; conducts training; assigns tasks and monitors work performance; writes and delivers performance appraisals; recommends salary actions; recommends and administers disciplinary action; recommends and approves termination of employees and engages and retains a high performing, accountable workforce.
- Collaborates with top leadership to identify strategic goals.
- Plans, staffs, budgets, and manages expenses for the Legal department.
- Drafts, analyzes, reviews and/or negotiates contracts, grants, loan documents, policies, and agreements.
- Serves as legal advisor to ensure compliance with various regulatory issues related to our industry and business; and creates and implements strategies to mitigate legal risks for the company.
- Judges the merits of court cases filed against or on behalf of the company, works with stakeholders to define a strategic defense and approves settlements of disputes where warranted in conjunction with senior leadership.
- Manages and supervises any litigation involving the company and its affiliates with outside counsel as needed.
- Oversee the organization’s compliance with government laws, regulations, and public funder’s contractual, reporting and audit requirements.
- Responsible for implementing HIPAA Privacy and Security measures for the organization and is the point of contact for all HIPAA related issues for the organization.
- Oversee and manage all potential or actual health related claims (may involve medical malpractice claims, which may be eligible for Federal Tort Claims Act coverage).
- Oversees organization of legal document system, from state registrations to operating agreements.
- Oversee organization’s General Liability, Property, Auto, Worker’s Compensation, Employer’s, Cyber and Crime insurance, and acts as the liaison with the insurance broker.
- Responsible for the management and processing of claims-related activities, fitting with the organization’s Claims Management Procedure, and serves as claims point of contact for the organization.
